Prosecutors Seek Confidential Files In Rodriguez Case

The U.S. Attorney's office says Alfonso Rodriguez waived his attorney-client privilege by claiming ineffective counsel during trial.

 

 

 

 

There are new developments in the appeal of convicted killer Alfonso Rodriguez. Prosecutors want a federal judge to grant them access to certain confidential motions, orders, proceedings and reports filed by Rodriguez's former attorneys.

The U.S. Attorney's office says Rodriguez waived his attorney-client privilege by claiming ineffective counsel during trial. Prosecutors say they need the materials to respond to claims that Rodriguez's trial attorneys failed to investigate, challenge and introduce evidence on his behalf.

Rodriguez is on death row for the kidnapping and murder of Dru Sjodin. Part of his appeal has claimed he's mentally retarded and should not be put to death.
