ST. PAUL, Minn. (AP) - A new court filing contends Minnesota legislators hold all the power to fashion titles for constitutional ballot questions.

The filing suggests the secretary of state has chosen a substitute meant to sway votes on a gay marriage measure.

Lawyers for Republican lawmakers and the Minnesota for Marriage submitted a brief to the Minnesota Supreme Court on Wednesday.

It's the last filing before the high court hears arguments about a title switch.

The swap surprised backers of a ballot measure to add a same-sex marriage ban to Minnesota's constitution.

Democratic Secretary of State Mark Ritchie reworked the title due to appear above the question, citing authority under state law.

His would read: ``Limiting the Status of Marriage to Opposite Sex Couples.''

Amendment backers say the new name could tilt votes against it.
