FARGO - There is a legal challenge to the proposed $1.5 billion Red River Diversion.

Upstream opponents are planning a federal lawsuit to stop the project in its tracks. The Richland-Wilkin joint powers authority will take the corps of engineers to court.

Fargo Attorney Cash Aaland is a concerned landowner and a joint powers authority committee member. Aaland says the authority, made up of commissioners and others in the two counties to the south of Fargo, believes that the diversion would violate national flood control policies.

The authority also cites the North Dakota constitution in its argument.

A St. Cloud law firm has been hired to represent the authority. Aaland says the court review could take up to a year.
