N.D. Hotel Says Federal Lawsuit Should Be Thrown Out

A company that operates a Minot hotel says it should be not be held liable for a man's injuries that resulted from a fall.

MINOT, N.D. (AP) - A company that operates a Minot hotel says it should be not be held liable for a man's injuries that resulted from a fall.


Brian King, of Sarnia, Ontario, has filed a federal lawsuit against Hanuman L.L.C., which operates the Dakota Inn. He's seeking unspecified damages.


King says there wasn't a guard rail or sufficient lighting in place outside the hotel last September when he fell 4 feet to the parking lot. The suit does not describe his injuries.


Hanuman filed its answer to the complaint last week. The company says the sidewalk conditions would have been "open and obvious" and any injuries were the result of negligence by King and others.


Hanuman is asking for the lawsuit to be dismissed.
