The City of East Grand Forks is stepping up its battle against the owners of a Fargo-based lingerie and adult store.

 

 

 

 

The City of East Grand Forks is stepping up its battle against the owners of a Fargo-based lingerie and adult store.

In a federal lawsuit, Fantasy's owners Kim and Jim Patterson claim East Grand Forks is stopping them from engaging in constitutionally protected activity.

The city is asking a federal judge to dismiss the case. In a 20-page response, defense attorneys say the argument does not apply because the sale of sexual novelties is not protected by the First Amendment.

Fantasy's opened for just one day before it was shut down. East Grand Forks officials say the store violated local zoning laws.
