A final vote could come up as soon today in the North Dakota Senate that would make some cases of animal cruelty punishable by up to a class "C" felony.

In a hearing yesterday, an amendment passed 34-to-13 that would change when the crime is considered a misdemeanor and when it's a felony.

Senator Larry Luick of Fairmont says the charges contained in the original bill were deemed too steep by some.

The part of the amendment that got the most attention was a section that says if a violation involves a herd or group of animals of the same species, it is counted as a single incident.

Luick says it would it would be up to the prosecutors to decide if the crime should be counted this way or in extreme and intentional cases, per animal.
