The North Dakota Supreme Court has rejected an appeal over medical treatment by a Cass County man who killed and dismembered a Wisconsin man.
Dennis Gaede filed a complaint after a dentist pulled his tooth at the state pen instead of a root canal and crown Gaede had requested. Gaede accused state officials of cruel and unusual punishment.
A lower court had decided the case should not go to trial. The Supreme Court ruled prisons have no constitutional right for requested treatment.
Gaede is serving a life sentence for killing Timothy Wicks in 2001 at his home in Gardner.
