The owners of an adult-themed store that recently closed in East Grand Forks, Minn. have filed a federal lawsuit against the city.
"Fantasy's" owners Kim and Jim Patterson claim the East Grand Forks zoning code is unconstitutionally vague. The lawsuit says the ordinance gives city officials "unbridled discretion" to grant or deny permission to engage in constitutionally protected activity.
Fantasy's was open for one day in East Grand Forks before the city shut the business down.
The owners previously tried to open in Grand Forks, N.D., but the store was blocked because it was located too close to a school.
Fantasy's is a Fargo-based company that sells lingerie, costumes and sex toys.
