N.D. Supreme Court Rejects Property Tax Lawsuit

BISMARCK, N.D. (AP) - North Dakota's Supreme Court says people who support abolishing property taxes don't have authority to enforce state laws against illegal campaigning.

The Empower the Taxpayer group is backing Measure 2. It's a constitutional amendment to abolish property taxes. The measure will be decided in Tuesday's election.

The group sued Tax Commissioner Cory Fong and other public officials. The group says Measure 2's opponents are lying about its potential effects and illegally spending taxpayer money to fight it.

The Supreme Court's ruling Thursday says only prosecutors can enforce North Dakota's law against illegal campaigning. The court says private enforcement lawsuits aren't allowed.

The Supreme Court's ruling was unusually quick. The justices heard arguments in the case only two days ago.
