BISMARCK, N.D. (AP) - North Dakota's Supreme Court has affirmed the conviction of a man who was sentenced to 40 years in prison for sexually abusing a young girl.
Vincente Chacano says the Adams County prosecutor dismissed the charges against him once. He was accused of repeatedly molesting a girl who was under age 15.
Chacano says the charges were refiled later without any further investigation.
The Supreme Court's ruling says the charges were refiled after an assistant attorney general decided there was enough evidence to convict Chacano. The court says the prosecutor wasn't required to do more investigating.
Chacano's case drew attention last year because he pulled a gun in the courtroom after a jury convicted him.
Chacano was convicted of two counts of attempted murder for the pistol incident.
