Six American Indian students at the University of North Dakota who sued the university and state officials over the school's Fighting Sioux nickname say they will not appeal a federal judge's dismissal of their lawsuit.

GRAND FORKS, N.D. (AP) - Six American Indian students at the University of North Dakota who sued the university and state officials over the school's Fighting Sioux nickname say they will not appeal a federal judge's dismissal of their lawsuit.
U.S. District Judge Ralph Erickson last month threw out the lawsuit. He said an overwhelming statewide vote in June against the nickname, as well as the state Board of Higher Education's clear intent to retire the moniker, rendered many points in the lawsuit moot.
Attorney Carla Fredericks, who represented the students, said that while there is a legal basis for appeal the students feel that the objective to end use of the nickname has been met.
