Wahpeton Man Sentenced For Fatal Motorcycle Crash

A Wahpeton man charged in a fatal motorcycle crash has been sentenced to a year in jail.

WAHPETON, N.D. (AP) - A Wahpeton man charged in a fatal motorcycle crash has been sentenced to a year in jail.

Thirty-five-year-old David Berning in March pleaded guilty to negligent homicide. State law requires a mandatory minimum sentence of a year behind bars. Berning will be on supervised probation for two years following his jail time and must pay nearly $15,000 in restitution.

Berning was charged after a motorcycle collision last Sept. 5 that resulted in the death of his passenger, 25-year-old Mallie Breuer of Mooreton. Authorities say he had been drinking alcohol before driving.

Authorities say Berning lost control of his bike after striking the rear wheel of another motorcycle he was traveling with on Interstate 29 in Richland County, throwing Breuer into the ditch, where she died.
