A judge has ruled that there is enough evidence for the case against Fargo doctor Jon Norberg to move forward.
The decision to schedule the case for trial came at the conclusion of a preliminary hearing for Norberg.
Norberg is accused of drugging his wife with a powerful painkiller and having sex with her without her knowledge.
Defense lawyer Bob Hoy, a former Cass Couunty State's Attorney, argued that the claims of Alonna Norberg were trumped up to gain an advantage in a bitter divorce and child custody battle.
Jon Norberg, a former Sanford Medical Center surgeon, has pleaded not guilty to felony sexual assault and reckless endangerment. His trial is set for August 28th.
